OT: My Mom got jacked up, any reccomendations?

So around 1 month ago she was leaving work (she works at walmart). The knuckleheads waxed the crap out of the floors and didnt tell anyone or put up any signs up. So she walks out tired and falls flat on her back, 4 people that work there saw her, and they caught it on tape. She just got her results back and the doctor said her spine is tweaked and the discs in her back are 8-9mm apart (worst the doctor has seen is 6mm). They are going to have to shoot her spine with cordozone or something, and she will never be able to have a stand up job AGAIN. Doctor says she will eventually be crippled and in a wheelchair. She is now thinking about suing, what do you guys think?

Any experience with this sort of thing?

She has a friend that works there now and she is suing the company and still working. My mom said she can probably sue and still work the desk or be a door greeter.

I was telling her not to do it, but now I am thinking yes. I hear you have up to 1 year to file, it has only been 1-2 months, so it doesnt look like she is sue happy, cause she wasnt going to, and she just found out her results. Today she tells me they are overworking her, she is supposed to be sitting down, but they have her answering phones near the fitting rooms and getting up and down to open doors and let people in the dressing rooms, when they know she isnt supposed to, she comes home at night almost in tears from the pain.

SOB's.

Any Attorneys here?

Donald Wal Mart makes up for 17 percent of the WORLD'S retail sales...they have more than enough money sue the damn company. MY dad got hurt on the job site and they awarded him 75k it was a long trial but in the end it was the companies fault. Im sorry to hear about your moms man i couldnt imagine if that happend to mine.

bottom line take it to walmarts ***!!

If you dont mind me asking, what did he hurt? 75k seems pretty low.

But I guess if it didnt have long term effects, then that is GOOD.

If you can get the doctor to testify to the his opinion that your mom's "Doctor says she will eventually be crippled and in a wheelchair" and get a second opinion....then you have a solid case. Unsafe working conditions or improper saftey protocals.

he hurt his back it wasnt a long time injury but it was enough to send him the therapy etc.

If she ever needs a good attorney let me know, I know a couple of top dogs in the business.

Thanks Clark.

And thank you everyone else that shows their support. Lots of you SoCal guys here know my parents personally, so you know how down to earth and cool they are, they are both totally down with the Maxima crew I will tell her all of the kind things you guys have said, she will appreciate it and I know she will be even more motivated to do something.

The suit may take a while, just be very patient. They'll probably settle out of court if the evidence is that clear in her favor, on tape and witnesses, so be patient.

Wal-Mart is the stiz-ore! But I hear a lot of bad stuff about them sometimes. They pose as the "friendly" stores, but ya know, the store is representative of what kind of employees are hired. Sometimes they hire employees that don't really understand english or whatever and cause havoc to customers. But this isn't the point right now.

But being that your moms is an employee, and what I said above DOES NOT mean her, I would strongly urge sue or worker's comp... is she even getting worker's comp? She should be. With a back injury you described, it sounds like she should be going to some back therapy or something. ALL that therapy stuff and medical stuff should be paid out by Wal-Mart, or the insurance provider if Wal-Mart has that.

I don't know you much, but I hope your moms is not paying ANYTHING! from her own pocket to pay for any medical services related to her back. Because when I think about it again, what would the Wal-Mart administration be doing RIGHT NOW had your moms not been an employee but a customer instead. I bet you that they would be stressing and hoping that she won't pull suit on them or someting. I hope they're not taking advantage of your mom's dedication and hard work.
