I am going to file a lemon law report with the state and make Nissan fix the car or take it back. There is clearly a safety issue here and I am not willing to take the risk.
Please do. When mine goes bad, I'll just go thru the motions of the 3 required repairs and then file. Nissan will eventually take note.
Been there, done all of this. With VW. And won an unprecedented case. And went broke doing it.
I am considering filing a lemon law complaint. I am going to give the dealer one last oppurtunity before I file. I agree I do not feel safe in the car, especially for a car that retails for 40K !
I have the same rocking issue. Dealer kept it for a week and finally replaced the track. Dealer said it was fixed. When I got in, the seat was lowered all the way to the floor and didn't rock. Great if you are 7' tall. Adjusted it to my standard position and it rocks again. Also, had 2 flat spotted tires when I got the car. Dealer replaced them after trying 3 times to balance. It's a little better.
I am also starting to notice a little movement in my driver's seat. Not much, but just enough to notice. Also, my 09 make a very high-pitched whistling sound while it idles. It stops if I rush the engine a little or while I am in motion. I took it to the dealership and they said that this sound was normal but I/m not so sure. Anyone else hearing this sound?
My dealer replaced the seat frame and the rocking is gone. The first replacement still rocked, so they overnighted another one. Two weeks on, still no signs of the rocking. All performed under warranty.

Unless you are a Labrador Retriever (or other breed of dog; all dogs can hear very high pitched sounds), you may have the only whistling '09 Maxima. Have the dealer take you around the block and show you this sound in another '09 Maxima. Bet he can't.
This may be some sort of vacuum hose not properly attached? I can't think of many things on a car that cause a high whistling noise. My Maxima 'sighs' when I come to a stop, and my wife always mocks it with a 'sigh' of her own. At which point I usually sigh also.

But most of those had more than one replacement seat before the problem was fixed. And we still have a good-size group here who have rocking seats, some of which have had at least one replacement seat installed without success.
Nissan should have grabbed this problem when it became widespread last winter, taken definitive steps to find out EXACTLY why this was happening, and come up with a clear, positive fix early on, making sure all subsequent cars coming off the assembly line no longer had this problem. Would have saved them money, time and a tarnished reputation.

Took mine into the dealership yesterday to have them look at my rocking drivers seat and the shaking passenger seat. The service guy that checked me in said he has never heard that they were having problems with the seats. I gave him the bulletin number for the passenger seat and said the driver's seat is a well know issue on the internet. So I don't know if he was playing dumb or what, but he kind of got pissed when after I told him. I hardly believe anything the service guys tell me anyway, just from past experience. Anyways, within 15 minutes they said they hard to order parts to correct the problems, duh... The parts they are ordering are #87351-9N00B (frame assembly - front; $922.40) for the driver's and #87414-9N00B (Bracket - Front Seat; $25.19) for the passenger's. Just in case anyone wanted to know.
bizarjuggalo - Couldn't help but notice you are in Mt Juliet TN. My wife and I had a nice meal there the week we were in Smyrna visiting the Nissan plant 17 months ago. I am really surprised a Nissan dealer located that near the place where EVERY '09 Maxima is built did not know of the seat problems. Let us know how the replacement parts work.

Neither my wife nor I could remember the restaurant name. Two reasons for that: It has been 17 months, and we eat out every day, so have eaten at hundreds of places since then. We do remember we had spent the day at the Hermitage, and were taking a circuitous route back to our motel in Smyrna. The only reason we remembered eating there is because neither one of us had ever heard of Mt Juliet before that stop to eat.
I have heard several folks here on the ORG say they think the dealer gets paid more for non-warranty repairs than for warranty repairs. If that is true, then I can see why some dealers are a little slower about accepting warranty work.

FWIW, I remember going in to ask about chrome strips that clouded on the 6th gen's, the service MANAGER said - "Gee - I haven't seen anything like that".
My service advisor said - "B*** $hit" - we've done dozens of them.
I have been in contact with Nissan USA about the problem. Basically, they are acting like they don't know about the driver seat issue. Total joke. The Georgia lemon law doesn't require three repair attempts if it is clear that the dealer/manufacturer won't fix it.
They clearly are dragging their feet on this and I have had enough. I wish somebody who worked for Nissan would come on this forum and admit that they know that there is a problem and that they will fix it, but they won't even do that.
Brought my car in today for the 7500mi service. I called this morning to set up an appt. for later this week, and when they said they could do it today I took it in.
At the check-in, I mentioned the rocking driver's seat, and was told they had never heard of it before.
After the service, the advisor said they could find nothing wrong with the seat and that "it performed to mfr specifications." The invoice reads: "Compared to another car and they are both the same. No problem found at this time."
Being annoyed, I came back online tonight to find this driver's seat NTB issued on Sept. 15, 2009.
Needless to say, I'm not happy, but I hope this helps others with the driver's seat issue.
I just took mine in today to have them check out a couple things on the car....was told that its normal for the seat to rock a little...told the guy my 72 K5 Blazer seat dosen't move and I've wheeled the hell out of it....told him the first time the seat went forward I though it was not going to stop, that it caught me off guard and I didn't think it was something the car should do.
Oh well, got a call in to Nissan about something else and will have to talk about this too

Light- while it's been almost two decades since I was a factory warranty administrator, I can confirm that. Factory warranty work at one point was quite profitable for both the techs and the dealership. Those days are gone, as the factories have revised their labor rates and reimbursement downwards for sometime now.
Still, the all-important CSI ratings may hinge on how quickly and efficiently warranty issues are resolved. Even having an issue like this can negatively effect both the dealer and Nissan.
For all of you who is wondering if the rocking seat was fixed on the 2010; NOPE. I thought the rocking seat was due to a car accident I was in after driving my car off the parking lot a drunk driver hit us from behind. During the week that I was waiting to take my car into the repair shop, I noticed that my driver seat would rock as I came to a stop or pulled off. Immediately I thought this was due to the accident. I will be contacting my service guy Monday to let him know that the rocking is a well know issue with the new generation max's.
Since Nissan do not want to recognize the issue, we all should report it so they will issue a recall for the vehicles.
