Problems with my local dealer

My car is showing symptoms of the "clutch howl." I took my car in to my local Nissan dealership. The tech was able to duplicate the problem. Now, I was told by the tech and the Service Manager that they would pull the tranny apart. They also said that when the tranny was apart, if they noticed any signs of abuse on the clutch disc or flywheel (excessive burn spots, glazing), Nissan would not warrant the repair and I would pay for all work done up to that point, including putting everything back together. This would be about $800. If there were no signs of abuse they would cover it. I have seen many used clutches, and not even once have I seen one that did not have burn spots all over it. I told them this was not a chance I was willing to take (having to pay for the repair). I know there is a TSB on this problem. Shouldn't the dealership follow the TSB's repair procedure, no matter what condition the flywheel and clutch plates are in? Car is going in tomorrow for possible oil leak from the transmission, I would like to get the clutch problem fixed as well.

The TSB is at http://maxima.theowensfamily.com/tsb/

Obviously they suspect that you've abused your max. However, the level of abuse that warrants voiding warranty service is highly debatable. Get your data and second opinions to back you up in case they claim you clutch is burned. But I'd suggest going to another dealer if you get a feeling they're going to screw you and deny coverage.

The only problem is the nearest dealer is in Kansas City. So I'm kind of stuck. I even called the dealer in KC and I told them what my dealer was saying and they confirmed they would go about it the same way. A tsb signifies a known problem. You would think they would take care of it either way. How do you like KC btw?

It might be a long drive for you, but my wife uses the Nissan dealer up here in St. Joseph. She keeps buying Nissan's because they treat her very fair and don't talk down to her like other dealerships have. In fact, they replaced the power window motor in her car yesterday and brought the car to our house! We could never talk anyone into doing that before so we were floored when they offered it.

Of course they wanted to drive the car to your house. It's a MAXIMA!

Occasionally I hear the howling clutch. Dealer told (showed) me that it was a bronze brushing in the assembly that was making the noise. He attributed it to pressure and said unless it got really bad or I started having <real> clutch problems that it would be pointless to fix.

Which dealer did you call? The only Nissan dealer I'd recommend in the KC Metro is McCarthy. They're awesome and actually give discounts to members of kcmaximas.org. You local guys should check the site out. And I love KC. Just the right size for me.
