Glad to be back sort of

Its glad to be back after being in serious car accident with my brother in his M3 2 weeks ago. We where rear ended at 45 mph by a drunk guy in 95 Deville and were pushed out into a intersection and hit by another car on the passenger side. I was out for 2 weeks solid with a 8 broken ribs, 5 slipped disc in my back, pinched nerves, broken right leg and foot, cut up face (from the side impact), punctured lung and a host of other stuff wrong. I cant get around right now and yesterday was the first day I had the strength to visit this site, my wife said you must be going crazy not being on that site, my borther has some serious injuries as well. Take care guys I cant wait to get back into the Max.

I am sorry to hear this. I am glad you and your brother made it out alive. How about the drunk driver? Let me guess he was perfectly fine

I cant believe those pieces of $hit drunk drivers. I realy hope he had insurance and that his boat of a car collapsed on him and that he is still in jail from being charged with attempted man slaughter(if he was actually charged with anything). but most important how is your brothers M3...J/K I truly hope that you get better. best wishes

Why waste money on Maxima? He could be driving a lot nicer car depending on how much he got; if indeed got a settlement check.

Thanks guys I am doing alot better but pretty useless for now, my brother wasnot as bad off as I since I took 2 hits(rear and side). The driver was 42 and he walked away with a bloody nose and of course he didnot have insurance, he let is lapse 2 months prior.

Sucks about the drunks insurance. I was in a similar accident with my brother. We were on a red light in March 2001 and a drunk smashed us from behind going 50 mph. We were his brakes. Nothing happened to my brother, but I was going to a doctor for over a year. The drunk also tried to start his car and drive away, but the car was too messed up. Funny part was that he was driving the same kind of car I was driving.

As long as you have 'uninsured' or 'underinsured' on your policy, it doesn't matter if the other driver has insurance. Get yourself a very good lawyer. With the level of injury you've sustained and the potential for chronic back pain in the future you probably are good for a settlement north of a hundred thousand dollars(assuming the policy limit was high). I'm not a lawyer but I've been through a serious accident(not as serious as yours, thankfully) and I got a fair amount for it.

Good luck on your recovery.

how do they go after the uninsured? i was worried about that when i was hit by an older lady but thankfully she was insured. isn't it required by law to have insurance?

dmv should revoke this SOB's license, and you should get the DA involved in charging this guy with attempted vehicular manslaughter.

6spmax is right. As long as your brother is insured, and carries adequate limits you will be able to file an uninsured motorists bodily injury claim with your brothers carrier (insurance follows the vehicle). If you exhaust the UMBI coverage under your brothers policy, you can then pursue a umbi and then a underinsured motorists bodily injury claim under your policy then.

Get yourself a good personal injury atty.

After your atty/brothers insurance/your insurance gets through with the drunk driver, he will wish he hadn't been born. Assuming the guy has any assets, business, home, vehicles, bank acct, etc, they will go through these assets like butter and bankrupt the guy. They are entitled to recovery when paying a claim on your behalf.

I'm in the insurance industry. PM me if you have any other ?'s.

Good luck with your recovery, it will be a long and arduous journey. Keep your head up man!

Well I don't know exactly how they'll go after the uninsured but thankfully, that's the insurance company's problem, not yours. If the uninsured person that hits you doesn't have anything, the insurance company won't get anything from them. That's the risk they assume.
